CONTRACT
DISPUTES
Alan has
had an interest in contract disputes since being involved for a couple of years
in the 1980s as a study engineer for a large litigation case. This interest was
rekindled when involved in a large arbitration case that ran from 1997 to 2000.
Alan subsequently undertook formal training by completing the University of
Adelaide’s Professional Certificate in Arbitration (2003). Alan subsequently
joined the Institute of Arbitrators and Mediators Australia (2004) and is a
regular attendee at their CP functions. In 2004 Alan successfully completed the
Adjudication Training Certificate, but as the mining industry is currently
excluded from the application of the adjudication law in Western Australia he
has not sought registration.

Griffin
was involved in litigation with the State Energy Commission over contractual
matters. Throughout the time of the preparation for the case I was consulted on
various mining related matters and
prepared various reports required for legal counsel.
WMC Resources - Mt Keith Nickel Mine. (1997 - 2000)
Assisting with preparation of technical
arguments associated with a multi (tens) of millions of dollars arbitration
claim by a contract mining organisation.
Great Central Mines Limited – Jundee and Bronzewing Gold Operations. (1998)
Working with associated consultants and
solicitor to advise on a contract dispute with the mining contractor. Assisting
the client to prepare new contract documents, both for the open pit and
underground operations.
